Terms of Service

These Terms of Service govern your access to and use of Recruitifie's AI-powered recruitment platform. Please read them carefully before using our services. By creating an account or using the Platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Recruitifie ("the Platform", "we", "us", or "our") — available at recruitifie.com and any associated mobile applications or services — you ("User", "you") agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional terms applicable to specific features of the Platform.

If you are accessing the Platform on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. If you do not agree to these Terms, you must discontinue use of the Platform immediately.

We reserve the right to update these Terms at any time. Continued use of the Platform after any changes constitutes your acceptance of the revised Terms. We will notify registered users of material changes via email or an in-platform notice.

2. User Accounts and Eligibility

To access core features of Recruitifie, you must register for an account. You agree to provide accurate, current, and complete information and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must be at least 18 years of age to create an account. By registering, you represent that you meet this requirement. The Platform is not directed to individuals under the age of 18.

You may not create more than one personal account without our prior written consent. Accounts registered by automated means, bots, or on behalf of third parties without authorization are prohibited.

3. User-Generated Content and Intellectual Property

You retain ownership of your content. Any content you submit, upload, or otherwise make available on the Platform — including resumes, cover letters, job postings, profile information, messages, and portfolio materials ("User Content") — remains your intellectual property. You are solely responsible for ensuring that your User Content does not infringe on any third-party rights.

By submitting User Content to the Platform, you grant Recruitifie a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, transmit, display, reproduce, and process your User Content solely for the purpose of operating, improving, and providing the Platform's services. This license terminates when you delete your User Content or close your account, except where retention is required for legal compliance or where your content has been shared with other users.

You may not upload, post, or transmit content that is unlawful, defamatory, obscene, harassing, fraudulent, or infringes on the intellectual property rights of any third party. Recruitifie reserves the right to remove User Content that violates these Terms without prior notice.

All Platform software, design, code, trademarks, logos, and content created by Recruitifie are the exclusive property of Recruitifie or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use Recruitifie's trademarks, logos, or brand assets without express written permission.

4. AI Processing Disclosure

Recruitifie is an AI-powered recruitment platform. By using the Platform, you acknowledge and consent to the following:

  • Resume and profile analysis: Your uploaded resume, profile data, work history, and skills may be processed by AI systems — including models provided by third parties such as OpenAI and Anthropic — for the purpose of matching you with relevant job opportunities, generating compatibility scores, and providing career recommendations.
  • Job posting optimization: For recruiter accounts, job postings and requirements may be analyzed by AI to improve candidate matching, suggest skill requirements, and generate outreach content.
  • No guaranteed accuracy: AI-generated match scores, career recommendations, and compatibility assessments are provided for informational purposes only and do not constitute professional career or hiring advice. Recruitifie does not guarantee the accuracy, completeness, or fitness for a particular purpose of any AI-generated output.
  • Human oversight: Final hiring decisions are the sole responsibility of the employer. Recruitifie's AI tools are intended to assist — not replace — human judgment in the recruitment process.
  • Data minimization: We transmit only the data necessary to generate AI outputs. Your data is not used to train third-party AI models without your explicit consent.

5. Subscription Billing and Payment Terms

Recruitifie offers both free and paid subscription plans. Paid plans are available on monthly or annual billing cycles. All prices are displayed in U.S. Dollars (USD) unless otherwise specified.

Automatic Renewal: Paid subscriptions automatically renew at the end of each billing period (monthly or annual) unless you cancel before the renewal date. By providing your payment information, you authorize Recruitifie to charge your payment method for all applicable fees on the renewal date.

Annual Plans: If you subscribe to an annual plan, you will be billed the full annual amount at the time of purchase and at each annual renewal. Annual plans are discounted compared to the equivalent monthly rate.

Plan Upgrades and Downgrades: You may upgrade your plan at any time; the new rate will be prorated for the remainder of your current billing period. Downgrades take effect at the start of the next billing period — you will retain access to your current plan's features through the end of the period already paid for. We do not offer prorated refunds for mid-cycle downgrades unless otherwise stated.

Failed Payments: If your payment fails, we will attempt to reprocess the charge. If payment is not collected within 7 days of the due date, your account may be downgraded to the free tier or suspended until payment is received.

Taxes: All fees are exclusive of applicable taxes. You are responsible for all taxes, levies, or duties imposed by taxing authorities in connection with your use of the Platform, excluding taxes on Recruitifie's net income.

Payment processing is handled by Stripe, Inc. Your payment information is transmitted directly to Stripe and is subject to Stripe's terms of service and privacy policy. Recruitifie does not store your full credit card or banking information.

6. Refund Policy

14-Day Money-Back Guarantee: If you are not satisfied with a paid subscription, you may request a full refund within 14 days of your initial purchase or annual renewal date. To request a refund, contact us at support@recruitifie.com with your account email and the reason for the request.

The 14-day guarantee applies only to the first payment of each subscription term (initial purchase and each annual renewal). It does not apply to:

  • Monthly renewal payments after the initial 14-day window has passed
  • Plan upgrades or add-on purchases
  • Accounts suspended or terminated for violations of these Terms
  • Requests submitted after the 14-day window has closed

Approved refunds will be processed to your original payment method within 5–10 business days. Upon processing a refund, your subscription will be downgraded to the free tier immediately.

Outside of the 14-day window, Recruitifie does not offer partial or prorated refunds for unused subscription time. All subscription fees are non-refundable except as expressly stated in this section or as required by applicable law.

7. Acceptable Use Policy

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Platform to post fraudulent, misleading, or discriminatory job listings
  • Use the Platform to collect, scrape, or harvest personal information about other users without their consent
  • Submit false or fabricated information about your identity, qualifications, or work history
  • Use automated tools, bots, or scripts to interact with the Platform in a manner that places unreasonable load on our infrastructure
  • Attempt to gain unauthorized access to any portion of the Platform or its underlying systems
  • Transmit viruses, malware, or other harmful code through the Platform
  • Use the Platform to send unsolicited commercial communications (spam) to other users
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Violate any applicable laws, including employment discrimination laws, privacy laws, and export control regulations

Recruitifie reserves the right to investigate and take appropriate action against any User who, in our sole discretion, violates this policy, including removing User Content, suspending or terminating accounts, and reporting violations to law enforcement.

8. Account Suspension and Termination

Your right to cancel: You may close your account at any time through your account settings or by contacting support@recruitifie.com. Upon cancellation, your account will be downgraded to the free tier at the end of your current billing period (if applicable), and your data will be handled in accordance with our Privacy Policy.

Our right to suspend or terminate: Recruitifie reserves the right, in its sole discretion, to suspend or permanently terminate your account and access to the Platform at any time, with or without notice, for any of the following reasons:

  • Violation of these Terms of Service or our Acceptable Use Policy
  • Providing false or misleading information at registration or in User Content
  • Engaging in fraudulent, abusive, or harmful conduct on the Platform
  • Non-payment of fees due
  • Any conduct that Recruitifie determines, in its reasonable discretion, is harmful to other users, third parties, or the Platform

Upon termination for cause, you will not be entitled to a refund of any prepaid fees. If we terminate your account without cause, we will refund any prepaid fees on a prorated basis for the unused portion of your subscription.

All provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

9. Disclaimers and Limitation of Liability

AS IS: THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR AVAILABILITY. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

NO EMPLOYMENT GUARANTEE: Recruitifie makes no representation or guarantee that use of the Platform will result in employment, the hiring of qualified candidates, or any particular business outcome. Job matching, AI-generated scores, and career recommendations are provided for informational purposes only.

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RECRUITIFIE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION — ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM, EVEN IF RECRUITIFIE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL RECRUITIFIE'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO RECRUITIFIE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Recruitifie, its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your User Content, including any claim that your User Content infringes the rights of any third party
  • Your use of the Platform in violation of applicable law
  • Your misrepresentation of your identity, qualifications, or authority to act on behalf of an organization

Recruitifie reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

11. Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the data practices described in our Privacy Policy.

The Platform is not directed to children under the age of 18. If we become aware that a child under 18 has provided us with personal information, we will take steps to delete that information promptly.

12. Dispute Resolution and Governing Law

Governing Law: These Terms and any dispute arising from your use of the Platform shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Informal Resolution: Before initiating any formal proceeding, you agree to first attempt to resolve any dispute informally by contacting us at legal@recruitifie.com with a written description of the dispute. We will attempt to resolve the dispute informally within 30 days of receiving your notice.

Binding Arbitration: If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the Platform shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in English and the arbitrator's decision shall be final and binding.

Class Action Waiver: You agree that any arbitration or proceeding shall be conducted solely on an individual basis. You waive any right to bring or participate in a class action, collective action, or representative proceeding. You also waive any right to a jury trial.

Exceptions: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration. Claims related to intellectual property infringement may be brought directly in court.

Jurisdiction: For matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in the State of Delaware.

13. Third-Party Services and Links

The Platform may contain links to third-party websites, services, or resources. These links are provided for your convenience only. Recruitifie has no control over the content, privacy practices, or terms of such third-party services and is not responsible for any loss or damage that may arise from your use of them.

The Platform integrates with third-party services including Stripe (payment processing), Google (authentication and analytics), Resend (email delivery), and AI model providers. Your use of these integrations is subject to the respective third-party terms of service and privacy policies.

14. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy and any other policies or agreements incorporated herein, constitute the entire agreement between you and Recruitifie with respect to your use of the Platform and supersede all prior agreements.

Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable. The remaining provisions will continue in full force and effect.

Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision in the future.

Assignment: You may not assign or transfer these Terms or any rights hereunder without our prior written consent. Recruitifie may assign these Terms, including in connection with a merger, acquisition, or sale of assets, without restriction.

Force Majeure: Recruitifie shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, strikes, or internet or infrastructure outages.
